1. Acceptance and eligibility
By creating an account or using the Service, you confirm that you are at least the age of majority in your jurisdiction (or have parental consent), have the authority to bind any organisation you represent, and will comply with these terms and all applicable laws.
2. Description of the service
Postify provides a platform to manage communications across multiple channels, including but not limited to WhatsApp, Facebook, Instagram, and Google Business. Features may include posting and scheduling content, sending messages, managing inboxes, analytics, and team/workspace management. We may add, change, or discontinue features with reasonable notice where practicable.
3. Account and security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must notify us promptly of any unauthorised use. We are not liable for losses arising from unauthorised use of your account due to your failure to safeguard your credentials.
4. Acceptable use
You agree not to use the Service to:
- Violate any applicable law, regulation, or third-party rights.
- Send spam, unsolicited messages, or content that is deceptive, harassing, defamatory, or otherwise harmful.
- Impersonate any person or entity or misrepresent your affiliation.
- Attempt to gain unauthorised access to the Service, other accounts, or any systems or networks.
- Interfere with or disrupt the Service or the integrity of our or third-party systems.
- Use the Service in a way that could harm, disable, or overburden our infrastructure or violate the terms of any connected platform (e.g. Meta, Google, WhatsApp).
We may suspend or terminate your access if we reasonably believe you have violated these terms or applicable law.
5. Third-party platforms and compliance
Use of Facebook, Instagram, Google, WhatsApp, and other integrated platforms is subject to their respective terms and policies. You are responsible for ensuring your use of Postify in connection with those platforms complies with their rules (e.g. Meta’s Platform Terms, WhatsApp’s Commerce Policy). We are not responsible for changes to or enforcement of third-party policies.
6. Your content and data
You retain ownership of content you upload or create through the Service. By using the Service, you grant us a limited licence to use, store, process, and transmit that content and data as necessary to provide and improve the Service, in accordance with our Privacy Policy. You represent that you have the right to provide such content and that it does not infringe any third-party rights.
7. Intellectual property
Postify and its logos, design, and materials are owned by us or our licensors. You may not copy, modify, distribute, or create derivative works from our intellectual property except as expressly permitted (e.g. using the Service in the normal course). No licence is granted by implication.
8. Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE”. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. USE OF THIRD-PARTY PLATFORMS AND NETWORKS IS AT YOUR OWN RISK.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTIFY AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OR INABILITY TO USE THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM (OR ONE HUNDRED US DOLLARS IF GREATER).
Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, the above limitations may not fully apply to you.
10. Indemnification
You agree to indemnify and hold harmless Postify and its affiliates, officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, your violation of these terms, or your violation of any third-party rights or applicable law.
11. Termination
You may stop using the Service and close your account at any time. We may suspend or terminate your access or account for breach of these terms, non-payment, or for any other reason with notice where practicable. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive (e.g. disclaimers, limitation of liability, indemnification) will survive.
12. Governing law and disputes
These terms are governed by the laws of India. Any dispute arising out of or relating to these terms or the Service shall be subject to the exclusive jurisdiction of the courts of India. Nothing prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.
13. Changes to the terms
We may update these terms from time to time. We will post the updated terms on this page and update the “Last updated” date. Material changes may be communicated via the Service or by email. Continued use of the Service after the effective date of changes constitutes acceptance of the updated terms. If you do not agree, you must stop using the Service.
14. General
If any provision of these terms is held invalid or unenforceable, the remaining provisions remain in effect. Our failure to enforce any right does not waive that right. These terms constitute the entire agreement between you and Postify regarding the Service and supersede any prior agreements. You may not assign these terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
